IN GENERAL.—Not later than 1 year after the date of the enactment of this Act, the Secretary, the Attorney General, and the Secretary of State separately shall issue interim final regulations to implement this subtitle and the amendments made by this subtitle, which shall take effect immediately upon publication in the Federal Register.


APPLICATION PROCEDURES; PROCESSING FEES; DOCUMENTATION.—The interim final regulations issued under subsection (a) shall include—


the procedures by which an alien, and the dependent spouse and children of such alien may apply for status under section 245Bof the Immigration and Nationality Act, as added by section 2101of this Act, as a registered provisional immigrant or a registered provisional immigrant dependent, as applicable, including the evidence required to demonstrate eligibility for such status or to be included in each application for such status;


the criteria to be used by the Secretary to determine—


the maximum processing fee payable under sections 245B(c)(10)(B) and 245C(c)(5)(A) of such Act by a family, including spouses and unmarried children younger than 21 years of age; and


which individuals will be exempt from such fees;


the documentation required to be submitted by the applicant to demonstrate compliance with section 245C(b)(3)of such Act; and


the procedures for a registered provisional immigrant to apply for adjustment of status under section 245Cor 245Dof such Act, including the evidence required to be submitted with such application to demonstrate the applicant’s eligibility for such adjustment.


EXEMPTION FROM NATIONAL ENVIRONMENTAL POLICY ACT.—Any decision by the Secretary concerning any rulemaking action, plan, or program described in this section shall not be considered to be a major Federal action subject to review under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).
